Do you have a Guardian-ad-Litem that is insisting that you pay a retainer? Keep in mind that the GAL (guardian-ad-litem) is appointed by the court, not "retained" by you.

It has been my opinion, and I have so stated in seminars I have done and in an Advocate article on the Ethics of being a GAL, that retainers are not appropriate. Nonetheless, Court Visitors and GAL's have been asking for and getting such retainers in many cases. It is difficult to do anything about the practice except by having the petitioner refuse to pay the retainer, but agree to pay a reasonable GAL fee once the matter is completed (unless there is a prolonged case, where ongoing billings might be appropriate).
